The present article deals with the issue of the legislative framework of the formation of the Czechoslovak army at the beginning fo the Czechoslovak republic. After the short period of idealistic enthusiasm when some political representatives fo the republic considered the establishment of a militia type army based on the Swiss model, it was decided to build a permanent army based on the principle of conscription and military service, led by professional officers.
Even though the new army war formed using the French army as a model, it accepted numerous elements form the old Austro-Hungarian army. The formation of the militia system - although discussed in the preambule of the Conscription Act - was, in effect, rejected by the government fo the state.
The length of military sercie was gradually increased due to international tension.
