Abstract
Article describes tort law within the Framework of European law and concludes that there is no system of European Tort Law. European tort law find itself in great number both in primary and secondary union law without any concept and harmonisation.
In the situation of damage caused to the individual as a consequence of a mistake in transposing Europe and directive the member-state's tort liability showed follow the national legal order in the framework of the European case law.
