The relationship between legal protection under national law and the primary treatment of State liability for infringement of Community law

Abstract
With regard to the principles laid down by the ECJ, especially by the Frankovich, it is possible to conclude that the only entity responsible for the misconduct of a Member State's obligations under European law is, in only the Czech Republic. The author analyzes the liability under the law of State responsibility and the general provisions on damages in civil law and according eurokonformního interpretation of Czech law.
