Currently the question of the importance of codes is coming to the fore, because many institutes exist of commercial law in de-codified form. These institutes regulate individual special laws outside the Commercial Code.
In relation to the de-codified institutes the code represents a specific legislative pillar of every legal branch and represents a specific degree of stability and integrity and enhances the principle of legal certainty. The concept of the code lies in the internal coherence of legal norms, the so-called legal norms without internal inconsistencies.
The commercial law declares its specific nature thanks to its profiling as the law of businessmen while legal practice indicates the interest to reflect the specific nature of this field in which thanks to the concept social needs the balance is defined between codification, de-codification and re-codification process trends.
