Protective treatment as a new reaction to the actions of other crimes committed by children under fifteen years.

Abstract

Recents developments in brain research confirm limited capacity and incompetence of 11-15 aged children who committed crimes. In contrary to these findings in the Czech Republic increased influence of so called tough criminal policy concerning young children below the age of criminal responsibility who commited crimes.

The last amendment of the Juvenile Justice Act (came in force on 1.11.2011), that has introduced so called cumpulsory medical treatment in closed institution for delinquent children, represents one of these non rational reactions of criminal policy.
