Generally the rule that the more restrictive the policy in the field of regular migration is the more space is open for irregular migration is systematically ignored by the current European policy. Irregular migration has two forms: 1) the form of illegal crossing of the state borders when this type of migration then is related with trafficking in people and wide scale of the criminal activities, whose principal victim is an irregular migrant; or 2) the form of overstaying by extending the initial regular stay or by perfoming activities directly forbidden by the type of regular permit (e.g. irregular employment while on the study visa).
In such cases irregular migration is directly related to irregular employment of the migrants and their employment abuse. This group at the same time is the most numerous type of irregular migrants.
