Genesis of a judiciary conflict: the Constitutional Court of the Czech Republic declares a CJEU's judgment as an ultra vires act

Abstract

The Constitutional Court of the Czech Republic considered the judgment of the CJEU (Landtová) as an ultra vires act of this EU organ. The Constitutional Court failed with its decision to enhance the relationship betwenn the CJEU and national constitutional courts.
