Protection against abuse of law process in the Brussels I. Review. Proposal

Abstract

Inspired by a reform of Regulative Brussels I and based on the so called torped actions author suggests an ammendment which should prevent in abuse of procedural rights by the parties. The solution lies in the narrowing (limitation) of the notion of the subject of proceedings which would enable the use of his pendens exception ware frequently and more efficently.

Also the penalties for abuse of rights should be introduced.
