Abstract
The text provides basic information about the application of laws related to risk behaviour for teachers and educational staff. The introduction presents the types of risk behaviour and their manifestations, followed by a list of principles of efficient primary prevention.
It also provides a list of the basic legislative instruments in the competence of the Ministry of Education related to the area of risk behaviour, and goes on to discuss the areas of misdemeanour and criminal law. The text points out the correlation between the departmental legal instruments and the misdemeanour and criminal law, emphasising the absence of certain legislative instruments and thus the need to address risk behaviour in a form other than legislation.
The author concludes the paper with a proposal for expanding the training of teachers and educational staff to include the area of law related to risk behaviour and by pointing out the non-existent or low "safeguard" of legal certainty for this staff.
