Abstract

The author deals with the development of the federal judiciary in the USA in the last decade of the 18th and in the first quarter of the 19th century. The problems are mainly trying to capture the perspective of dramatic constitutional developments that took place in this period, in which he often just the federal judiciary was in the front line of the fight between the then warring factions in American politics - Federalists and Republicans.
