The importance of judicial decisions in criminal law

Abstract

In this chapter, the author deals with a question on the importance of judicial decisions in criminal law. According to principle of equal treatment and due to demand for legal certainty, it is necessary to have constant judicial decisions on particular questions which might be reached through a persuasive argumentation and proper publication of these decisions.

Amongst other judicial decisions the Czech Constitutional court’s decision-making has a unique position since we consider its decisions to be a primary source of criminal law.
