The potential of the constitutionalisation of budget law as part of financial law

Abstract

Debt problems are inherent to many countries, and they are solved in different ways. Within the EU, they have been proposed common solutions, but also individual Member States can deal with this issue separately.

Czech Republic decided for a solution by way of a separate preparation of constitutional act that would define the particular debt brake system and some other issues (e.g. the establishment of the National Budget Council). Debt solutions in the sphere of public budgets in the form of the constitutional act connects the budgetary law with constitutional law.

The choice of this approach to the solution may in the future provide a variety of legal issues that will probably be presented to the Constitutional Court.
