Probability in substantive law and standard of proof (A short study on possible chance of a paradigm)

Abstract

Czech procedural law does not aknowlidge notions the probability and standard of proof. This approach hat to be changed since the nation of probability has been introduced into a Czech New Civil Code.

The study deals with notion of probability and its impact on the evaluation of proofs; it analyses also the relationship between proof and probability, probability and conviction. Author also comprises the Czech, German and Austrian law.
