Questioning the Recent Challenge of the Czech Constitutional Court to the ECJ

Abstrakt

The article deals with the judgement of the Czech Constitutional Court (CCR) in the so-called Slovak pensions case. By this judgement CCR challenged the ECJ Landtova judgement via the invocation of the ultra vires doctrine.

The article questions the reasons and justifications for this challenge.
