Just satisfaction under the European Convention on Human Rights

Abstract

The aim of this article is to provide an overview of the mechanism of just satisfaction according to Article 41 of the European Convention on Human Rights. The basic conditions for awarding of a just satisfaction are defined on the grounds of theoretical sources and case law of the European Court on Human Rights.

In the practical part of the paper the authors made a controversial comparison concerning the amounts awarded by the Court as the just satisfaction to individuals and legal persons. The analysis of the judgments from the past two years showed that the amounts of the just satisfaction for breach of the right to property reach millions euros, while the just satisfaction for breach of the right to life ranges in the amounts of tenth thousands euros.

However, there is a logical explanation, which is given in the end of the paper.
