Federal Solution to the EU internal sovereignty conundrum : The European doctrine of the Czech Constitutional Court and the United States' Compact Theory

Abstract

The author compares the sovereignty doctrines in the ante-bellum US and in new Eu Member States and offers a solution to the tension between the unit and the central government in composed entities by reviving the original understanding of federalism.
