On the 1st of March 2006 the Convention on International Interest in Mobile Equipment (so called Cape Town Treaty), signed also by the Czech Republic, came into force. The aim of the article is to analyze the Convention in its relevant international law context as well as in the context of the development of the Czech and Slovak regulation in the field.
We focus on two basic aspects - substantive law and conflicts of law solutions and chosen system of opt-in and opt-out declarations which allows considerable variations in Treaty application.
