EU non-contractual liability for damages in the light of recent case law of the Court of Justice of the EU

Abstract

The article deals with the non-contractual liability of the European Union for the damage, which is enshrined in primary law and further developed case law of the Court of Justice of the EU. Analyzes in detail the specific conditions of admissibility of an action for damages and compares them with the responsibility of international organizations in public international law.

Also discusses various forms of damage, including loss of opportunity and considers the possible evolution of non-contractual liability of the EU in the future.
