Abstract
In the article I have tried to highlight some connection guarantees the right to a fair trial in misdemeanor proceedings analysis of individual procedural rights of the accused within the stages of proceedings before the administrative authority. When recodified misdemeanor law these issues would not fit in, as they are fundamental to the legitimacy of these cases criminal charges.
Special attention was paid in this connection procedures in proving a principle prohibiting the Reformation in peius.
