A right to exercise of public office as a cause of collision between the principle of democratic state and the rule of law in jurisprudence of Czech constitutional court

Abstract

The authors in this paper deal with the collision which arises between the principles, which is characterized by a democratic state on the one hand and the rule of law on the other hand, that may sometimes occur with the implementation of the right public office. In conclusion, the authors present the solutions present a collision.
