Abstract

A study of erosion of the concept overriding requirements in EU law is first paid directly to the question of how and to what depth may affect competition doctrine and the policy of the EU law. Next, the historical development of the concept of overriding requirements of the EU in terms of his unaffected in a certain doctrine and asks the Court why they blur the boundaries between exceptions under primary law and categorical requirements and also creates a competitive concepts whose relationship to the categorical requirements is very unclear.
