Abstract
The monograph is devoted to the creation of European Union legislation - the analysis and during the EU legislative process and the principles of legislative activity. Answers to the question, in what areas can be no EU legislation is adopted and where the legislative power belongs to the Member States, based on an analysis of the principle of conferral, and the division of powers between the Union and its Member States and causes a change in the scope of the powers conferred through formal or material amendment of EU primary law.
