Protection of the environment in the french constitution – The charter of the environment

Abstract

The environmental protection entered the French constitutional order in 2005.The Charter of the Environment is an ambitious and progressive constitutional document including rights, duties and principles fundamental for the protection of the environment. This paper describes the preparation and adoption procedure of the Charter, analyses the wording of its provisions and gives an overview of its current judicial application.
