On the passage of criminal liability of a legal entity to a legal successor

Abstract

The article discusses the problems arising from § 10, par. 1 of Act No. 418/2011 Coll., on criminal liability of legal entities and proceedings against them. Pursuant to the cited provision, criminal liability of a legal entity passes to all its legal successors.

This is a new principle of substantive criminal law, which changes the traditionally personal criminal-law or criminal-procedural relationship as we know it from criminal liability of natural persons.
