EU Law in the Czech Republic: From ultra vires of the Czech government to ultra vires of the EU Court?

Abstrakt

Article analyses constitutional framework for application of the EU law in the Czech Republic, both from perspective of the constitutional text and case-law formulated by the Constitutional Court. In particular, the article focuses on use of ultra vises argument and possible misinterpretation of its addressees in Slovak Pension case decided by the Constitutional Court.
