Abstract
The chapter is engaged especially in problematic parts in evolution of institute of usucaption and comparison of views on this mode of acquisition of ownership in legal history. It is focusing both on roman usucapio and current acquisitive prescription and also comparing it with acquiring ownership from unauthorized person.
Text is particularly concentrate on problems, which occurs in connection with ignoring existence of modern evidence and disregarding of law system as a whole in legislation.
