The Social Market Economy Goal of Article 3(3) TFEU - a Task for EU Law?

Abstract

The Lisbon Treaty set down for the EU the task to become a highly competitive social market economy with full employment. The paper inquires whether such a constitutional goal could be carried out by legislation adopted at the EU level.

In conclusion it proposes some legal changes to the primary law of the EU that would not substantively alter the distribution of competencies between EU and its member states but would nevertheless make the achievement of the social market economy goal more real.
