Abstract
The article is concerned with the up-to date application of the Insolvency Regulation No. 1346/2000 and briefly compares this regulation with the new Regulation No. 2015/848. The article is furthermore concerned with chosen provisions and concepts of the up to now regulation and offers its interpretation based on the recent judicial decisions of the European court of justice.
There follows a listing of the most important changes in the wording of a new regulation as well as a speculation on their practical impacts.
