Intertemporality on the border between substantive and procedural law: constitutive decisions

Abstract

The paper deals with constitutive decisions of civil courts from the perspective of time. It is based on the concept of "legitimate interest", which has been approved also by the current legislation (Code of Civil Procedure Sec. 1).

The basic thesis is reviewed on examples from practice.
