Human dignity and criminal defamation in Czech law - constitutional-law and criminal-law aspects

Abstract

The article deals with the mutual relations issues of human dignity in the plane of constitutional and criminal law. This author understands human dignity as an essential constitutional principle.

The article presents an insight into the regulation of the Czech criminal law, particularly in respect of the crime of "defamation" and gives it to the subsidiarity of criminal repression in the plane of substantive criminal law. At the level of criminal procedural law, the author considers the application of the new elements of the criminal process to that criminal act
