Abstract
This paper deals with the recent Supreme Court's decision Obergefell, holding the ban of same sax marriages unconstitutional. Despite the obvious differences between Czech and US constitutional review, this paper claims that Czech Constitutional Court could run in similar way, should it take its precedents seriously.
Since the majority of both peoples support same sex marriages, the fact that these decisions are majoritan is also highlighted in the paper.
