Abstract
The article deals with the necessity of re-codification of civil procedure. The necessity is seen in an increase of requests to the judge by extending their discretion , modification of the principle of predictability of the public administrations and the increasing number of so-called "Foreign element" in private law relationships.
The key issue is the future development of civil procedure and election of its concepion with regard to the fact that the efficiency of the Civil Procedure is directly related to the efficiency of the entire justice system.
