On the relationship between abandonment of punishment and criminal order

Abstract

The article deals with the relationship between criminal order and the institution of abandonment of punishment as criminal-law alternatives in the area of procedural and substantive law. The author describes their relationship not only from the perspective of de lege lata legislation-analysing whether it is possible to abandon punishment by means of a criminal order-but also in terms of de lege ferenda legislation, presenting proposals for future regulation in connection with the discussed new codification of procedural criminal law.
