Abstract
The article deals with question whether the general liberty to act is a fundamental right or not. After answering the question of the content of the general liberty from the view of civil and constitutional law follows analysis of issue whether is this liberty is one of elemental principles of democratic state based on the rule of law and how is structured state, whether from below or from above.
