Basic principles of criminal procedure represent one of the most important conceptual issues needed to be addressed in the new Czech Code of Criminal Procedure. This is due to their cognitive, interpretative, application and regulátory signifikance.
They are the cornerstones on basis of which the conception of criminal procedure is based, as wel as the organization of criminal proceedings and regulation of law enforcement authorities and their activities. Discussion on the inclusion of the basic principles of criminal procedure and their wording in the new Czech Code of Criminal Procedure shall be preceded by a fundamental decision as to which conception of the future Czech criminal precedure is desirable.
In recodification of criminal procedure, it is necessary to maintain the link with substantive criminal law.
