Abstract
The article deals with the issue of amendment of the act no. 418/2011 Coll., on criminal liability of legal entities and proceedings against them that was adopted by the Chamber of Deputies of the Parliament of the Czech Republic on 24 May 2016. This amendment extends the sope of crimes which might be committed by a legal entity from 1 December 2016 when the amendment comes into effect.
On the other hand, there is an effort of legislator to enable legal entities to exclude their criminal liability for any acts of a governing body and/or an executive of a legal entity since the amendment contains a new section 8(5) according to which a legal entity will exclude its criminal liability provided that it can prove it has undertaken all the effort that can be reasonably required to prevent a crime from being committed.
