Business agents within the operation of a business

Abstract

This contribution is about the procurist officer, the head of a registered branch, and the person to carry out a certain activity within the operation of a business (business agent in the narrower sense). The provisions for the procurist officer are in the section of the Civil Code regarding contract representation.

The provision for the head of a registered branch is in the section of the Civil Code regarding assets and their division. Finally, business agent in the narrower sense is provided for in the section regarding an entrepreneur.

So each of them is in a different section of the Civil Code. This fact cannot be a barrier for a uniform interpretation.

The aim of this article is to show the intersections between the three cases of business agents.
