Decision making concerning healthcare to pediatric patients in the Czech Republic

Abstract

The text points out the unsatisfactory legal certainty arisen from current legal regulation on providing healthcare to minors. The protection of life and health of a child belongs to the most priority values of the Czech society which results in a weakened position of the parents or other persons who take care of the child.

In practice, there can be conflicts between the will of the minors, their parents and healthcare workers about a further treatment, esp. as regards the the boarder between insufficient treatment, adequate treatment and overtreatment. Unfortunately, at this moment, the law does not offer clear solutions either.
