The state of emergency in the contect of the refugee crisis and its solution on the EU level

Abstract

In this paper, we focus on the problem of states of emergency from an EU perspective. We ask ourselves what it means to decide on a state of emergency under the terms of shared or pooled sovereignty? We concentrate on two recent decisions of the EU Council on the relocation of asylum seekers, which was adopted as a reaction to the so-called migration or refugee crisis.
