Abstract
The author discusses the development rights of the defense in what is now the Czech Republic since the middle of the 18th century and since the code of the emperor Marie Terezie as well as basic knowledge about the right to a defense, which relate to the adversarial process with inquisitorial elements. The chapter is thus devoted primarily to fundamentals, definitions, history, extent of the rights of the defense.
