Some issues connected with the "supposed" legal act in employment relations

Abstract

Beside the invalidity of legal act the presented paper also deals particularly with the new consequences of a defective legal act which is non-existent or "supposed" legal act. The first part of the paper highlights the new concept of an invalid legal act in the Civil Code and its impact on labour relations.

The next part of the paper focuses on some substantive and procedural issues related to the application of the institute of "supposed" legal act on labour relations. Furthermore, the paper also provides a detailed analysis of the fundamental distinctions between invalidity and "supposed" legal acts with an emphasis on the practical impact of these differences on the participants of employment relations.
