Towards a social market economy in the EU: a constitutional conundrum?

Abstract

The increased unemployment, especially among young people, as a result of the economic and financial crisis, has increased inequalities and allegedly weakened the Union's economic performance and socio-political stability. It is against this background that this article purports to look into Article 3 of the Treaty of the European Union and its provision on the social market economy, seen as a truly long-term EU objective, which sets an integrated social model.

This article is thus aimed at establishing whether, based on the fundamental principle of conferred powers, the EU has the competence to legislate for a social market economy.
