Trail blazing in Europe - legal regulation of way marking in the selected European countries

Abstract

The purpose of my article is to analyse and compare legal regulations of trail blazing in the European countries. This comparison focuses on two main aspects.

The first one is the right to carry out the trail blazing, i. e. the right to enter a property to carry out the activity and the corresponding obligation to allow such an activity, i. e. such as entering a property. The second aspect is the comparison of legal regulations of administrative delicts consisting of destroying or removing a marking, or even placing an unauthorised marking.

The study is basically composed of two parts. First part describes the situation in the Czech Republic.

Firstly, it examines relevant Czech legislation, secondly, it briefly illustrates the history of the regulation of way marking on the territory of the present Czech Republic. The second part of the paper is the comparative part.

In this second part there are firstly introduced legal regulations of the countries neighbouring with the Czech Republic. These regulations are examined in great detail especially because the neighbouring countries share similar legal culture with the Czech Republic.

Then there are addressed legal regulations in other European countries, where the current situation was investigated. Of course, the countries, where there is in existence a detailed legal regulation of way marking, were introduced in more detail.
