The Preliminary Ruling Procedure of the Court of Justice of the European Union (CJEU) Initiated by the Czech Courts
Abstract
The thesis deals with the issue of Preliminary Ruling Procedure before the CJEU initiated by the Czech courts. Attention is in particular paid to the analysis of the obligation to submit a preliminary question by a Czech court as well as to the exceptions to this obligation, specification of the bodies submitting the preliminary question to the CJEU, applicable Czech legislation including the development of case law of Czech courts in the given area.
The conclusion of the work brings an answer to the question of protection against a breach of the obligation to submit a preliminary question, both at the national and transnational level.
