Abstract

The Monograph "Current Issues Related to the Injured Party and Decisions on Damages in the Czech Republic and Slovak Republic" contains a discussion on the status of the injured and the victim of the crime, including the decision to award damages in criminal proceedings in two neighbouring Central European countries which combines not only the common history but also the common legal order. Since the founding of two separate states, in which the former Czechoslovakia was divided in 1992, ie. the Czech Republic and Slovak Republic, the twenty-four years have passed and the common law has been gradually divided, which is also true for the criminal proceedings.

The submitted study presents and analyzes the rights of persons injured by crime in the Czech Republic and the Slovak Republic and discusses the principles of damages in so-called adhesion proceedings as part of criminal proceedings. At the same time, it offers a view of adhesion proceedings as part of a criminal proceeding in which the court decides on the private claims of the victim arising out of a criminal offense.

It also deals with the status of the victim of the crime, which is not always the same as that of the injured as a party to the criminal proceedings.
