The chapter provides a comprehensive discussion of the trajectories of constitution-making in Central and Eastern Europe since 1989, the adherence of the post-communist countries to the Council of Europe and the European Convention on Human Rights, as well as the enlargement process of the European Union towards the post-communist countries. It highlights the problems in these processes and pays particular attention to recent cases of 'backsliding'.

In conclusions, the chapter suggests some lessons for countries in the post-Soviet space, part of the European Neighborhood Policy.
