The chapter addresses the current issues related to the costs of legal assistance provided to the injured party in Czech criminal proceedings. It analyzes the individual legislative changes and development of related case law, which on one hand reflects the modern trend of strengthening the role of the injured party in criminal proceedings; however, on the other hand, it appears that the changes related to legal assistance to the injured party are not being adopted with an appropriate consideration of their practical impact, e.g. from a fi nancial perspective.
It describes the method for determination of the attorneys' fees (agents of the injured party) and designates the persons carrying these costs. It also addresses the latest developments on this issue, the outcome of which the author presents on a model case.
It appears that the agents' fees may easily exceed the compensation for damage to the injured party, and also the attorneys'fees for the accused (whose role is still undoubtedly more signifi cant in Czech criminal procedure).
