Charter of Fundamental Rights of the EU in the case law of the Constitutional Court of the Czech Republic

Abstract

Charter of Fundamental Rights of the EU became legally binding in 2009, hence it should be applied in the EU Member States. In the Czech Republic, the Constitutional Court plays a key role in this context because it makes decisions in cases affecting fundamental rights and freedoms.

At present one may make certain conclusions concerning the status of the Union Charter in the Czech legal order.
