Relationship between Courts and Mediation in premediation phase : Competition or symbiosis

Abstract

This paper examines the issue of mediation-court interaction. It aims to answer the question whether or not this kind of cooperation could be regarded as an advantage in favour of the disputing parties.

It approaches the topic of mandatory mediation too.
