Fundamental Rights in European Union Procedural Law (Problems of State Aid Proceedings before the European Commission - Sketch)

Abstract
The authors discuss in their contribution the controversial topic of procedural rights of the state aid beneficiary in the framework of the illegal state aid procedure before the European Commission. The beneficiary has only minimum rights that do not correspond to his actual importance for the solution of the problem.
The authors also present a proposal for a more adequate regulation de lege ferenda.
